1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Citadel FPS regarding your access to and use of the Citadel FPS software application, website (citadelfps.com), and related digital services.

By downloading, installing, or purchasing an access pass for Citadel FPS, you agree to be bound by these Terms.

2. Description of Product & License Grant

Citadel FPS provides digital software tools designed to optimize Microsoft Windows 10 & 11 operating system configurations for enhanced gaming stability, memory clearing, and latency reduction.

Subject to your compliance with these Terms and payment of the applicable access fee, Citadel FPS grants you a non-exclusive, non-transferable, revocable license to install and run the software on personal computer hardware designated by your license key (1 license key per active hardware device, subject to reset allowances).

3. Merchant of Record & Payment Processing

Our order process and payment services are conducted by authorized Merchant of Record partners (including Paddle.com and associated acquirers). The Merchant of Record is the Merchant of Record for all our orders. They provide all customer service inquiries related to order processing and handle returns and sales tax compliance.

4. User Responsibilities & Acceptable Use

You agree not to:

Reverse engineer, decompile, disassemble, or attempt to derive the source code of Citadel FPS.
Circumvent, disable, or tamper with any cryptographic license validation or HWID verification features.
Redistribute, resell, rent, lease, or publicly host downloaded copies of the software binaries or license keys.

5. Disclaimer of Warranties & Limitations of Liability

Citadel FPS is provided on an "AS IS" and "AS AVAILABLE" basis. While our optimization suite creates native Windows System Restore points before modifications and adheres to documented Windows APIs, Citadel FPS makes no representations or warranties regarding specific framerate gains, as hardware and software configurations vary.

To the maximum extent permitted by applicable law, Citadel FPS shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the software.

6. Termination

We reserve the right to revoke or suspend your license key without prior notice if you violate these Terms or engage in unauthorized key sharing or binary tampering.
